A team of class action lawyers has launched an investigation into the marketing practices of certain companies who send unsolicited facsimile advertisements to residential and/or business telephone fax machines.
Potential violations of existing laws include the sending of materials advertising the commercial availability or quality of any property, goods, or services via facsimile machine to any person without that person’s prior express invitation or permission or without an established business relationship and failure to include certain required disclosures in fax transmissions.
Consumers and businesses who receive unlawful fax advertisements have a right to sue to: (i) enjoin future transmissions and/or (ii) recover the greater of $500 in statutory damages or actual monetary damages for each unlawful junk fax, and if a court finds that the fax sender willfully or knowingly violated the law, the court can increase the award up to three times the amount of any such damages.
