A team of class action attorneys and personal injury lawyers has launched an investigation into Topamax®, a seizure, epilepsy and migraine drug developed by Ortho-McNeil Janssen Pharmaceuticals and marketed by Johnson & Johnson, and Topiramate, the generic version sold by Teva Pharmaceuticals, Watson Pharmaceuticals and Mylan.
Topamax® and Topiramate lawsuit claims potentially being investigated include claims by women who were treated with Topamax® or Topiramate during pregnancy and gave birth to children born with oral cleft defects such as cleft lip or cleft palate.
On March 4, 2011, the U.S. Food and Drug Administration (FDA) issued a drug safety communication
informing the public of new data that reportedly shows that there may be an increased risk for the development of cleft lip and/or cleft palate (oral clefts) in infants born to women treated with topiramate (Topamax® and generic products) during their first trimester of pregnancy.
Cleft lip or cleft palate may affect the formation and visual appearance of the upper lip or roof of the mouth of a child and can lead to issues with the child’s feeding or eating, talking and speech issues and ear infections. Children with cleft lip or cleft palate also may require revision surgery to correct and treat the birth defect.
