Class Action Suits, There's Safety in Numbers

What are class action suits?
It's not easy to sue a large corporation. Some cases can cost hundreds of thousands of dollars to bring to trial, and most people do not have the resources to handle such costs on their own. You don't have to go it alone in class action lawsuits. You can share the cost of litigation with thousands of individuals like yourself who have been injured by the misconduct of a large corporation.
A class action suit typically begin when an experienced lawyer locates an individual (known as the "named plaintiff") who has been injured. If the attorney's investigation reveals that other individuals sustained the same or similar injuries, the attorney will file suit on behalf of the named plaintiff as well as the thousands of unnamed victims (known as the "class") who have suffered similar injuries as a result of the defendant's conduct.
Once the court approves the case, the attorney will send a notice to potential class members, who can then decide whether or not they wish to join the lawsuit.
The attorneys for the class get paid only if they win the case. If the case is successful, the attorneys' fees are taken out of the damages awarded to the class, subject to the court's final approval.
There are four basic types of class action suits:
- Consumer: Consumers are frequently victimized by illegal sales and marketing practices, such as excessive late fees in contracts and cancellation penalties in membership agreements. Consumer cases can be brought to recover all such amounts illegally taken from you. Most states require dating companies to disclose consumers' rights to cancel before accepting payment. If the dating company LavaLife* failed to tell you those rights, it may not be able to keep all of the money it charged you.

- Employment: When an employer hurts a large group of employees or employment applicants through discrimination, refusing to pay overtime, or other illegal conduct, you can bring an employment lawsuit to recover damages and stop your employer's wrongful conduct.

- Product liability / Personal Injury: If a corporation has negligently caused you injury through selling unsafe products or other wrongful conduct, you may file a lawsuit to recover all of your damages. Merck & Co. *, one of the world's largest pharmaceutical companies, announced that it is halting the sale of the arthritis drug Vioxx and recalling it from store shelves due to new data from a clinical trial found that use of Vioxx increased the risk of heart attack and stroke.

- Securities: If you are a shareholder of a public corporation, you have the right to a file as securities lawsuit to recover any losses incurred by the company as the result of wrongful or fraudulent conduct.
